Bankruptcy Litigation

Courtroom experience in Bankruptcy

No matter how well they know the U.S. Bankruptcy Code or how many bankruptcies they've filed — most consumer bankruptcy attorneys are not courtroom lawyers. Because of that, most people who run into difficulties during the bankruptcy process also have to change lawyers in mid-course.

At the Law Offices of Robert Lee Hamilton, we have both technical knowledge of bankruptcy law as well as litigation experience. This can benefit you in two important ways. First, you don't have to switch lawyers between filing and litigation phases of your bankruptcy. In this way you get to stay with someone you are comfortable with. Robert's comfort level with judges and juries allows us to be more aggressive in protecting your interests earlier in the case, knowing that we have the experience and trial skills needed to back those positions up.

Our Bankruptcy Litigation Practice

Common types of Chapter 7 bankruptcy-related issues and disputes include:

* Accusations of misconduct or criminal fraud: Making major purchases, taking out unsecured personal loans or providing false information to the bankruptcy court can all be grounds for a "dischargeability" complaint. If these claims are found to have merit, those otherwise dischargeable debts cannot be wiped out. Criminal charges may be filed as well.

* Post-bankruptcy creditor harassment: Creditors don't always take no for an answer — even with debts that have been legally discharged in bankruptcy. If you are continuing to be harassed by a creditor after having gone through the bankruptcy process, they are in violation of federal law and we can pursue remedies against them in court.
